District Attorney Now In The Collection Business
This may be old news to the rest of you from around the state, but here in Mobile the DA has recently instigated a restitution recovery unit as a special division of the DA's office pursuant to an act that was passed in 1995. (12-17-225) The statute provides for the recovery of bail bond forfeitures, court costs, fines, penalty payments, crime victim restitution and VCAs. There is a collection fee of 30 per cent of the total owed (and, get this, the court gets to keep only 25% of that, the rest going to the DA)
Long story short: I am attacking the constitutionality of this as Ex post facto, due process, etc. violations. Ideas on how to proceed.
